6. PROCESSING AND FULFILMENT OF ORDERS
6.1. Orders are processed during opening hours. The order can also be placed outside the times designated for order processing; if this takes place after the end of working hours, it is processed on the following day.
6.2. Under the contract of sale, the Service Provider is obliged to transfer ownership of the goods, and the User is obliged to pay the purchase price and to receive the goods.
6.3. If the seller is a business and the buyer is a consumer, and the seller undertakes to deliver the goods to the buyer, the risk of damage passes to the buyer when the buyer or a third party designated by them takes possession of the goods. The risk of damage passes to the buyer upon handover to the carrier if the carrier was commissioned by the buyer, provided that the carrier was not recommended by the seller.
6.4. In the event of the Service Provider's delay, the User is entitled to set an additional deadline. If the seller does not perform within the additional deadline, the buyer is entitled to withdraw from the contract.
6.5. The User is entitled to withdraw from the contract without setting an additional deadline if a) the Service Provider has refused to perform the contract; or b) the contract, by agreement of the parties or owing to the recognisable purpose of the service, should have been performed at the specified time of performance – and not otherwise.
6.6. If the Service Provider does not perform its obligation undertaken in the contract because the product specified in the contract is not available, it is obliged to inform the User of this without delay, and to refund without delay the amount paid by the User.
7. RIGHT OF WITHDRAWAL
7.1 Pursuant to Directive 2011/83/EU of the European Parliament and of the Council, and to the provisions of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the Consumer may, within 1 day of receiving the ordered product, withdraw from the contract without giving reasons and return the ordered product. In the absence of this information, the Consumer is entitled to exercise their right of withdrawal for up to 1 year. If the Service Provider provides the information after the expiry of 1 day from the date of receipt of the product or of concluding the contract, but within 12 months, the deadline available for withdrawal is 1 day from the communication of this information.
7.2. The Consumer may exercise their right of withdrawal by means of an unambiguous statement to that effect, or by using the model statement set out in Annex 2 of Government Decree 45/2014 (II.26.).
7.3. The Consumer may also exercise their right of withdrawal in the period between the day of concluding the contract and the day of receiving the product.
7.4. In the event of exercising the right of withdrawal, the Consumer bears no cost other than the cost of returning the product.
7.5. The consumer may not exercise their right of withdrawal
a. in the case of a contract for the provision of services, after the full performance of the service, if the business began performance with the consumer's express prior consent, and the consumer acknowledged that they lose their right of termination after the full performance of the service;
b. in respect of a product or service whose price or fee depends on fluctuations of the money market that cannot be influenced by the business, which may occur even during the deadline available for exercising the right of withdrawal;
c. in respect of a perishable product or one that retains its quality for a short time only;
d. in respect of a sealed product that, for reasons of health protection or hygiene, cannot be returned once unsealed following delivery;
e. in respect of a product that, by its nature, becomes inseparably mixed with another product after delivery;
7.6. Following the return of the product / or the arrival of the withdrawal statement, the Service Provider, pursuant to the above legislation, refunds the amount paid to the Consumer without delay, but no later than within 3 days of becoming aware of the withdrawal.
7.7. For the refund, we use a payment method identical to the one used in the original transaction, unless the Consumer expressly consents to the use of another payment method; owing to the use of this refund method, the Consumer incurs no additional cost whatsoever.
7.8. The Consumer is obliged to return the goods without undue delay, and in no case later than 1 day from the date of sending the notice of withdrawal from the contract to the Service Provider, or to hand them in at the Service Provider's address.
7.9. In the case of withdrawal made in writing, it is sufficient for the Consumer to send the withdrawal statement within 3 days.
7.10. The Consumer keeps the deadline if they return or hand over the product(s) before the expiry of the 1-day period. The return is deemed to be performed on time if the consumer sends off the product before the deadline expires.
7.11. The consumer bears only the direct cost of returning the product, unless the business has undertaken to bear this cost.
7.12. The Service Provider may withhold the refund until it has received the goods back, or the Consumer has provided proof that they have returned them: whichever is the earlier of the two is to be taken into account.
7.13. If the Consumer wishes to exercise their right of withdrawal, they may indicate this at any of the Service Provider's contact details in writing, by phone, or even in person.
7.14. The consumer is liable only for the depreciation resulting from use exceeding the use necessary to establish the nature, characteristics and functioning of the product.
7.15. Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses is available here.
7.16. Directive 2011/83/EU of the European Parliament and of the Council is available here.
7.17. The Consumer may also contact the Service Provider with any other complaint at the contact details found in these Terms.
7.18. The right of withdrawal is available only to Users qualifying as consumers under the Civil Code.
7.19. The right of withdrawal is not available to a business, that is, to a person acting within the scope of their profession, self-employment or business activity.
7.20. The procedure for exercising the right of withdrawal:
7.20.1. If the Consumer wishes to exercise the right of withdrawal, they are obliged to indicate their intention to withdraw at the Service Provider's contact details.
7.20.2. The Consumer exercises their right of withdrawal in time if they send their withdrawal statement before the expiry of the 3rd day from receipt of the product. In the case of withdrawal in writing, it is enough to send only the withdrawal statement within 3 days. In the case of notification by post, the date of posting is taken into account; in the case of notification by email or fax, the time of sending the email or fax is taken into account.
7.20.3. In the event of withdrawal, the Consumer is obliged to return the ordered product to the Service Provider's address without delay, but no later than within 3 days of communicating their withdrawal statement. The deadline is deemed to be met if the product is sent before the expiry of the 3-day deadline (i.e. it does not need to arrive within 3 days). The customer bears the costs arising in connection with the return of the goods due to exercising the right of withdrawal.
7.20.4. However, the Service Provider is not obliged to reimburse the Consumer for the additional costs arising from choosing a delivery method other than the cheapest usual delivery method offered by the Service Provider. The Consumer may also exercise their right of withdrawal in the period between the day of concluding the contract and the day of receiving the product.
7.20.5. In the case of the sale of several products, if the individual products are delivered at different times, the buyer may exercise the right of withdrawal within 3 days of receiving the last delivered product, or – in the case of a product consisting of several lots or pieces – the last delivered lot or piece.
8. Guarantee, warranty, Defective performance:
The obligor performs defectively if, at the time of performance, the service does not meet the quality requirements laid down in the contract or by law. The obligor does not perform defectively if the entitled party knew the defect at the time of concluding the contract, or should have known the defect at the time of concluding the contract. In a contract between a consumer and a business, any stipulation that deviates, to the detriment of the consumer, from the provisions of this chapter concerning warranty for defects and guarantee is void.
Warranty for defects
8.1 In which case may the User exercise their right to warranty for defects? In the event of defective performance by the Service Provider, the User may enforce a warranty-for-defects claim against the Service Provider in accordance with the rules of the Civil Code.
8.2 What rights does the User have on the basis of their warranty-for-defects claim? The User may – at their choice – exercise the following warranty-for-defects claims: they may request replacement, unless fulfilling the claim chosen by the User is impossible or would entail disproportionate additional costs for the business compared with fulfilling another claim. They may switch from their chosen warranty-for-defects right to another; however, the User bears the cost of switching, unless it was justified or the business gave cause for it.
8.3 Within what deadline may the User enforce their warranty-for-defects claim? The User is obliged to communicate the defect without delay after discovering it. Against whom may they enforce their warranty-for-defects claim? The User may enforce their warranty-for-defects claim against the Service Provider.
8.4 What other condition is there for enforcing warranty-for-defects rights? Within three days of performance, enforcing the warranty-for-defects claim has no condition other than communicating the defect, if the User proves that the product or service was provided by the business operating the webshop. After the lapse of three days from performance, however, the User is already obliged to prove that the defect recognised by the User already existed at the time of performance.
8.5. In which case may the User exercise their product-warranty right? In the case of a defect in a movable thing (product), the User may – at their choice – enforce a warranty-for-defects claim or a product-warranty claim.
8.6. What rights does the User have on the basis of their product-warranty claim? As a product-warranty claim, the User may request only the replacement of the defective product.
8.7. In which case is the product deemed defective? The product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics described in the description given by the manufacturer.
8.8. Against whom and under what other condition may they enforce their product-warranty claim? They may enforce their product-warranty claim exclusively against the service provider. In the case of enforcing a product-warranty claim, the User must prove the defect of the product.
8.9. In which case is the service provider (distributor) exempt from its product-warranty obligation? The service provider (distributor) is exempt from its product-warranty obligation only if it can prove that: – it did not sell the product within the scope of its business activity, the defect was not recognisable, or – the defect of the product results from the application of legislation or a mandatory official regulation. It is sufficient for the manufacturer (distributor) to prove one cause for the exemption. Please note that you may not enforce a warranty-for-defects claim and a product-warranty claim at the same time, in parallel, for the same defect. In the event of the successful enforcement of a product-warranty claim, however, you may enforce your warranty-for-defects claim regarding the replaced product or repaired part against the manufacturer. Guarantee
8.10. Furthermore, the Service Provider bears no warranty for damages that arose from defective or negligent handling after the risk of damage passed, from excessive use, or from effects other than those specified, or from other non-intended use of the products.
9. PROCEDURE IN THE EVENT OF A WARRANTY CLAIM
In a contract between a consumer and a business, the parties' agreement may not deviate from the provisions of the decree to the detriment of the consumer.
It is the consumer's duty to prove the conclusion of the contract (with an invoice, or even just a receipt).
The costs related to fulfilling the warranty obligation are borne by the Service Provider (Civil Code
Section 6:166).
The Service Provider is obliged to make a report of the warranty claim submitted to it by the consumer.
A copy of the report must be made available to the consumer without delay, in a verifiable manner.
If the Service Provider is unable to declare, at the time of its submission, whether the consumer's warranty claim can be fulfilled, it is obliged to notify the consumer of its position – in the event of rejecting the claim, of the reason for rejection and of the possibility of turning to the conciliation body as well – within five working days, in a verifiable manner.
The Service Provider is obliged to keep the report for three years from the time it is made, and to present it at the request of the supervisory authority.
The Service Provider must endeavour to carry out the replacement within three days at most.
10. MISCELLANEOUS PROVISIONS
The Service Provider is entitled to use a contributor to fulfil its obligation. It bears full liability for the latter's unlawful conduct, as if it had committed the unlawful conduct itself.
If any part of these Terms becomes invalid, unlawful or unenforceable, this does not affect the validity, legality and enforceability of the remaining parts.
If the Service Provider does not exercise a right to which it is entitled under the Terms, the failure to exercise the right may not be regarded as a waiver of that right. A waiver of any right is valid only in the case of an express written statement to that effect. The fact that the Service Provider does not, on one occasion, strictly insist on some essential condition or stipulation of the Terms does not mean that it waives insisting, in the future, on the strict observance of the given condition or stipulation.
The Service Provider and the User shall try to settle their disputes amicably.
The parties record that the Service Provider's webshop operates in Hungary and is maintained here as well. Since the site can also be visited from other countries, users expressly acknowledge that, in the relationship between the user and the Service Provider, the governing law is Hungarian law. If the user is a consumer, then, pursuant to Section 26(1) of the Code of Civil Procedure, in disputes arising from this contract against the consumer, the court with jurisdiction over the domestic place of residence of the defendant (consumer) has exclusive competence.
With respect to access to the products found in the webshop, the Service Provider does not apply different general access conditions for reasons relating to the User's nationality, place of residence or place of establishment.
With respect to the payment methods accepted by it, the Service Provider does not apply different conditions to the payment transaction for reasons relating to the User's nationality, place of residence or place of establishment, the place where the payment account is held, the place of establishment of the payment service provider, or the place of issuance within the Union of the cash-substitute payment instrument.
The Service Provider complies with REGULATION (EU) 2018/302 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on addressing unjustified geo-blocking based on customers' nationality, place of residence or place of establishment, and other forms of discrimination, within the internal market, and amending Regulations (EC) No 2006/2004 and (EU)
2017/2394 and Directive 2009/22/EC.
11. COMPLAINT-HANDLING PROCEDURE
11.1 The aim of our shop is to fulfil every order in appropriate quality, to the full satisfaction of the customer. If the User nevertheless has any complaint relating to the contract or its performance, they may communicate their complaint at the phone number or email address above, or also by letter.
11.2 The Service Provider examines the verbal complaint immediately and remedies it as necessary. If the customer does not agree with the handling of the complaint, or the immediate investigation of the complaint is not possible, the Service Provider makes a report of the complaint and its position on it without delay, and hands over one copy thereof to the customer.
11.3 The Service Provider answers the written complaint in writing within 2 days. It gives reasons for its position rejecting the complaint. The Service Provider keeps the report made of the complaint and a copy of the reply for five years, and presents them to the supervisory authorities at their request.
11.4 Please note that, in the event of the rejection of your complaint, you may initiate the procedure of an authority or a conciliation body with your complaint, as follows:
11.5. 11.7. The out-of-court settlement of the consumer dispute falls within the competence of the conciliation body. The task of the conciliation body is to attempt to bring about a settlement between the parties for the purpose of resolving the consumer dispute; in the event that this is unsuccessful, it makes a decision in the matter in order to ensure the simple, quick, efficient and cost-saving enforcement of consumer rights.
At the request of the consumer or the Service Provider, the conciliation body gives advice regarding the rights due to the consumer and the obligations incumbent on the consumer.
11.8. In the case of a cross-border consumer dispute connected with an online sales or online service contract, only the conciliation body operating alongside the metropolitan chamber of commerce and industry has competence for the procedure.
11.9. On the basis of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online resolution of consumer disputes (the Regulation), the European Commission has set up an online dispute resolution platform, which serves the out-of-court resolution of disputes arising in connection with obligations stemming from online service contracts between consumers resident in the European Union and service providers established in the European Union. The online dispute resolution platform has been available to consumers since 15 February 2016. The scope of the Regulation directly extends to service providers with a registered office in Hungary if a consumer dispute arises in connection with an online contract concluded between it and the consumer. Under the Regulation, the consumer may initiate online, via the online dispute resolution platform, the out-of-court resolution of the dispute at the jointly chosen dispute resolution forum. In Hungary, the Budapest Conciliation Body is entitled to resolve consumer disputes. The online dispute resolution platform is available at: http://ec.europa.eu/odr 11.10. The Service Provider is subject to a cooperation obligation in the conciliation body procedure. Within this framework, it is obliged to send its response letter to the conciliation body and to ensure the participation of a person authorised to reach a settlement at the hearing. If the business's registered office or premises is not registered in the county of the chamber operating the territorially competent conciliation body, the business's cooperation obligation extends to offering the possibility of a written settlement meeting the consumer's demand.
11.11. If the consumer does not turn to a conciliation body, or the procedure did not lead to a result, then the consumer, in order to resolve the dispute, has the option of turning to a court. The action must be initiated with a statement of claim, in which the following information must be indicated: the proceeding court; the names, places of residence and procedural positions of the parties, as well as of the parties' representatives; the right sought to be enforced, by presenting the facts underlying it and their evidence; the data from which the court's competence and jurisdiction can be established; a specific request aimed at the court's decision. The document, or a copy thereof, whose content is relied upon as evidence, must be attached to the statement of claim.
